model release problem

Allough this is not representative of Masies sisters concerns, some years ago a model sued a tog who sold photos of her without her permission, but when she admitted in court that she had recieved payment for the shoot she lost her case, the Judge concluded that as the tog had paid her for her time he had the right to sell the photos.

That is in essence what a model release is. A contract and receipt of proof of payment but if no money is inviolved then it canbe overturned rendering a release null and void

Is this advice free from Hiwatt Dave? I remeber not so long ago he was slinging around threats of court summons if anyone used his models while still under contract to him.

I would have thought it would be his models job to know that and not ours.
