Yes, so wouldn't any rational Judge rule in favour of human rights (with hugely important fundamental principles of freedom at stake) over some pathetically parochial small-time trading standards offence? Of course I understand that all judges are not rational and not withstanding their supposed impartiality might feel it in their best interests to rule in favour of the status quo or the establishment view.
