Officer Dibble - Never pass up a lavish lunch

I think Playboy would not have stood a chance in winning against Ofcom over the recent R18 debarkle because R18 is very clearly prohibited in the ITC (and now) Ofcom programme code. Having said that it will be interesting to see what happens in May. I believe that Ofcom will allow R18 on subscription only chanels, but if they don't that would be the time to take action against them not now.

The reason being that the Communications Act states that the code of the legacy regulators remains in force until a new code is put in place by Ofcom. But after the new broadcasting code is put in place the ghost of taste and decency will finaly be laid to rest and Ofcom will have very different set of legal issues to battle with such as 'generaly accepted standards must be applied', children must be 'protected' and in my opinion a key issue, 'consistent, proportionate and transparent regulation is to be applied at ALL times'. The realy important point here is that these are now legal requirements in statute law that can be challenged in court by judicial review.
