The legality of seling uncertificated DVD's or Videos has nothing to do with whether or not they are obscene under British Law.
The point of the Video certification bill was to both ban porn without having to find 12 good men and true to form a jury that would see sex as obscene and to tax competition from cheap film releases out of business.
Selling uncerticated material no matter what the content is now a crime , except for sport musical and documentary material.

I assume it is the 1984 'Video Recordings Act' of which you speak?

Then yes, all this stuff about obscene this and obscene that is moot. Because a video is either certificated or it is not. Black and white, there?s nothing to argue about. So, pass Stop and go straight to jail.

I can only talk about my own experience Officer but in my case it was the judge who decided what was obscene and if you get a do gooder judge who goes to church etc like I did then your in the brown stuff big time.

Add to that I lived in an area where people are very conservative in nature then I was screwed right over. I was warned about this by my brief who said that if I was in a big city then I would have definitely got only a fine but told me to be concerned because of my location.

They were proved right.

I agree with you that OPS have changed direction. They said as much to me when I last spoke to them last about 6 months ago.

However then I got done for selling NTSC versions of the US studios like Red Light. Most of those are for sale by Queensway and many titles get no BBFC cuts at all but if you have the unclassified version and not the R18 then you get done under the Video Recordings Act.

However the last time I only got a fine. Maybe a different judge or maybe societies more accepting of porn now I don't know.

I'm not disagreeing with you by the way. I do respect your opinion. I think we are singing from the same hymn sheet but with only a slight difference.

I can't answer your last question but I have another point that might help.

Are your Dvd's full on hardcore or are they just solo girl stuff with toys etc?

If they are the latter and that's the impression I got from your last post then you might be able to get a BBFC 18 cetificate and not an R18. 18 Certs can be sold anywhere I believe and sent through the post as they are not obscene material.

Obviously R18's aren't obscene either but there's the counter law of only being able to sell them in licensed sex shops.

18 certs could be the way to go if that's what your content is.

The truth is I don't know sponge bob and you may well be right. My experience in this industry is working for (other) online retailers and more recently myself.

Filming, producing and gettting certification is not my field. However I was rather hoping that other producers might have given their advice as they are the ones in the know on this topic. Which is why I posted the comment about solo girl and 18 certs as I thought someone would give their opinion.

Hopefully somebody still will.

Just one point about your previous post about being paid etc. I have two convictions under the obs pub act/vid rec act.

The first time I was done for distributing obscene material for financial gain. For that charge to stick then they had to prove the lot, that I was distributing and they had to prove that I was being paid. Which they could and did.

The second time I was done for distributing obscene material only. The financial gain part was taken off making it a lesser charge and hence a lesser sentence. Basically they couldn't prove I was being paid as I'd covered my tracks.

To be honest mate then I'd be absolutely amazed if the OPS came after you for solo girl with toys. They are not interested in full on hard core boy girl from what they tell me and only act if somebody complains.

It's paedo, animals, hardcore bondage and S&M. Solo girl with toys would be nowhere near their priority but I suppose you can never be too careful.
