Fisting isn't outright illegal, but obscenity is. And obscenity is decided by the local authorities. What is considered obscene in "smalltown, USA" could likely be OK in New York City. But the porn production systems and distribution systems are not able to control multiple versions for multiple locales, so they play it safe it and the result is self-censorship such as the 4-finger rule or simply editing out the fisting scenes. For example Seymore Butts "Tampa Tushy Fest" and "Tushy Girl Lost" both have real 5-finger to-the-wrist fisting scenes, and a "motivated" buyer can find the uncut version with a little extra effort. Same for some Max Hardcore titles. Same for some Zane titles. These uncut versions are known as "euro-versions", and are intended for sale in non-US locales with "healthy" porn laws, but some internet distributors sell the euroversions. Also, some of the companies will sell euroversions direct-to-consumer, with some requirement that the buyer "ensure" that the film does not violate his local standards. I have seen some reviewers refer to "American-stlyle fisting" to describe the no-thumb variety; others just call it fisting. So, when buying American, one must be very wary, because fisting means different things to different people, and some films have multiple versions, with no clear indication on the package as to edited vs. uncut version.
