Many of the things that are called 'accidents' are nothing of
the sort, there are very few true accidents.
My prat of a neighbour next door put up a swing for his children,
but it was facing the greenhouse and only a few feet from it.
If one of his children had fallen off it into the greenhouse he would
have called it an accident, but it would have been his fault for where
he put the swing, not an accident.
Many car 'accidents' are caused by bad driving, faulty brakes, driving
too close, driving too fast, driving under the influence of drink or
drugs, using your mobile phone, or just not paying attention.
The Zebrugee boat sinking was not an accident, but the boat setting
off before the doors were shut, and there are many other examples.

So if one of his children had fallen off the swing into the greenhouse and cut themselves badly then do you believe he should have criminal proceedings brought against him for negligence or whatever the charge might be?
To my mind it isn't negligence. Lack of forward planning or intelligence yes but does that make him a criminal?
