The law is a ass, a idiot

Thankfully the ones i get home from the bgafd events are OK.

Here we find yet more evidence that judges live in their own narrow world, competely cut-off from the real one.
Re: The law is a ass, a idiot
this particular judge has history when it comes to sentencing sex offenders. i think it was him that said a girl, who'd been sexually assaulted, should be given a nice new bike to help her get over it, whilst giving the offender a lenient sentence!

You ever read a book called Complicity by Iain Banks?
I think there's a scene in that where one of these fuckwit judges with a history of lenient sentences for rapists is threatened with being buggered stupid with a dildo.
If he doesn't understand the trauma associated with the assault, the mental scars caused, then what makes him qualified to pass sentence on a brutal animal who thinks his sexual urges take precedence over someone else's life?

Re: The law is a ass, a idiot
Was the girl actually "raped" here, ie forced against her will to have sex, or is this a case of "statutory rape"? If a girl is under 13, the law deems that she cannot give consent to sex, therefore sex with her is by definition rape, even if she appears to agree to it. It seems in this case the girl may have agreed to sex, and the men had no way of knowing how young she was. They are therefore guilty in law of rape, but in those circumstances the judge has used the discretion the law allows him in sentencing them. Seems fair to me.
Re: The law is a ass, a idiot
"According to a newspaper report she met the men and agreed to go with them to a secluded are but did not consent to sex, she was then taken back to one of the men's houses and raped again."
That's a bit ambiguous. In law, a girl of that age cannot consent to sex, whatever she might do or say. I can only say that the judge knows the law, he sat through the case and heard all the evidence, which we did not. Whether he got the sentence right is something which might be changed on appeal, we'll have to wait and see.

I can imagine a few 13 year olds looking 16-17 with the right/wrong clothing & makeup........maybe even the odd 12 year old, but 10?!
I think they both knew her age, consent or not.

If you were in court and were able to see the witness then fair enough, but since you weren't you know as much as the rest of us, which is a lot less than the judge in this case.
I'm not saying this judge was right or wrong, but it is very easy to be misled by newspaper stories which sum a a complex trial in a few paragraphs. If he has made a mistake in his sentencing, this will be corrected on appeal.
