The small claims route is the most sensible, relatively cheap and efficient CIVIL action you can take and if he doesn't pay up after a CCJ against him you can send in the bailiffs and/or bankrupt him/his business.

There is also a criminal element to this. This guy has a contract with you to pay your earnings he arranges for you less a commission.

In this instance he has not only failed to pay you, he has done everything in his power to retain the monies due, consistently lying and blaming others for the monies not appearing.

There is a simple word for that: FRAUD - and fraud is a criminal offence.

If you have evidence of his excuses - letters to/from the TV company, bank etc., take these to your local Police station and ask to see someone who is a specialist in fraud.

He may think you are too thick/are likely to be too ashamed to do this but, from what I've read and seen on TV you are a very bright lass who has chosen a career and has no hang ups about it.

Go for him with all guns blazing because, if you don't, he'll do this to others - he possibly is already. He shouldn't be in the adult - or any other - industry, except sewing mail bags.

Thanks for the support Mysteryman and everyone who replied :)This is a bit of an old thread now but an ongoing problem and I think it's time for the shit to hit the fan! Perhaps it might help other girls from getting screwed over too.

Below is an e-mail I received from this "agent" lets call him *Tom as I'm not allowed to name him on here and I thought it may interest some of you ;)

I've starred out the names of those involved to keep inline with BGAFD regulations.


"Here are where things stand at the moment. I have taken on a company of dedt collectors not the normal sort if you know what I mean these guys are activly persuing G** and the S**** for the huge amount of money they swindled out of me. I will get paid........

Here is something I bet you didnt know... All the money paid to me each week for you and C****** was not including VAT. when I said to G** I need VAT on top becausre each time I pay the models i have to pay the VAT to customs. G** said that they wernt interested in paying me the extra. This means that i now owe customs around ?6,000 because I did G** and you and C******l a fovour.. What a mug eh?

I have been speeking to other suppliers, clients and advertisers and they are not happy with what G** have done to them too.

P*** and T****** tell a completely different story about thier experiences of ***** and ****** they are owed money too.. not by me but its the same in the end.

I am sorry that you got caught up in things but hey sometimes it works like that.

When I get my money you will get yours its as simple as that......

Do not threaten me it wont work and it will just cost you money.........

If you bear with me I will sort things I cant do any more than that at the moment.

Oh and if in case you didn't spot it - the bit about vat is bullshit....as is a large proportion of it really?

You could always take out a summons in the County Court against him. He's probably a sole proprietor so if the court finds in your favour they will actually send round the bailiffs.

I did this some years ago for a car accident, it cost ?35 to do, (Probably more now) presented my case to the court and won. Ended up getting ?500 smackers, for a dent in a Lada.....I kid you not.

I actually did this because the bastard had threatened me at the time of the accident, so he had to be dealt with LOL.

So don't let the sod get away with it. I'm sure the citizens advice would help you fill out the form.

Kaz - depending on precise amount this could be a job for the Small Claims Court. A nice easy procedure that I've followed a few times in my professional capacity. If you want to proceed on this basis I'm happy to help you with the forms, as getting the wordings right is often critical to success.

"I am just a director..." lol ! I think that position comes with certain responsibilities, and whilst liability may be limited, the penalties for failure can include disqualification from future directorships. Might be worth a few searches via the Companies House website to piece some history together.

Take him to a small claims court, wont cost you a great deal if anything and it sounds like you have a good case.

Yes..Kaz..small calims court is the most cost efficient way to deal with this. I think you can still get the forms online at:

You can also get free legal advice at Citizens Advice (CAB) in your area. Look em up in Yellow pages.

I've litigated a few times using small claims and generally speaking the party with the most paperwork (emails, letters etc) is in the strongest position.
