Jimslip, you wouldnt need to catch an std before you could seek a prosecution as the mere fact that if a cert is forged this is in itself a specific offence, i can give you an example which has nothing to do with the adult industry but to do with cv fraud, i can mention this persons name as she has been sucessfully prosecuted Martha Kirkwood -Rhinds falsely claimed on her cv that she had a Bsc degree this was later found out to be false and she was sucessfully prosecuted of obtaining a pecuniary by deception ie: obtaining money by deception and was given a one year prison sentence, now as most performers are being paid then the same charge would apply if they falsified their certs, and of course if a clinic found out that a person was forging the clinics name on a certificate then that would be another offence, make no mistake about it forging sexual health certificates is an offence and if they are willing to lock a person up for forging a cv then i suspect that forging a cert would be considered more serious, and yes if you have evidence that someone may have used a false cert your first port of call should be the police.

It would not be a good idea to name and shame anyone before it had been proven in a court of law as you could find yourself open to litigation, as to how do you tell if a cert is a fake, well if it is a good forgery then it would be difficult but all certs will have a reference numbery and if you are at all unsure a quick phone call to the clinic quoting the reference number should confirm wether or not the cert is valid, if when you are doing this the other performer has made for the door then you would allready have had your answer, it is not to much trouble to keep copies of performers certs as most producers allready do with the IDs and forgery is illegal whatever industry you are in especially forging a document that could put another persons health at risk, there maybe some people who didnt realise they coulf face a prison sentence if found guilty of forging a cert but by making this post then hopefully it will enlighten a few.

All this talk about courts and prosecution.
If the industry wants to regulate itself better and appear to be that bit more professional than it is already then having a more effective scheme in place of the old one would be a logical next step. No need for all that time wasting, stressful and expensive stuff of legal action.
Another argument for having certs online.

Hi Terry, sorry i couldnt make it to Erotica i got bogged down with other things maybe we could meet up sometime in the not to distant future for a chat, but back to this post and as the database hasnt yet been adopted and there are still some unanswered questions then in the meantime surely there is nothing wrong with pointing out that forging certs is a criminal offence because even with a database not everyone would wish to be on it as there would be no guarantees as to who can access it but i do agree that with the right guarantees in place it would be a good thing, you may wonder why i have concerns about a database well as some of you may know that if you have ever had a hiv test which of course you would need for your certs and insurance companies became aware of this then you could find it difficult to get life or medical insurance in the future as they categorise any one who has been tested for hiv the same as they do for car drivers below a certain age, therefore i think more information about the database is needed before it is endorsed .

Hi Graham, yeah I was looking out for you but i heard some people didnt bother turn up as promised for the high price it was (some ?10 extra on Saturday)
anyway...
I answered this database question on this thread (post 101)
I appreciate your concerns and Im well aware of the private testing over NHS as I have various insurances as well.
There is'nt anything we havent thought of with regards to this scheme and I imagine the reason many do go private is for the reasons you mentioned. its why i did when I got tested.
The NHS route leaves a lot ot be desired and free isnt always the best option but i'll keep my opinion to myself at the minute since many favour the free option.
As for the criminal element of faking tests, yes Im sure it is there but as I stated before, why even go there when better preventative measures can be put in place to avoid the headache of this.
I can assure you Graham, this is the best way to go and if people are still going to throw up objections and opposition then you will only be getting in the way of this much needed change.

I am warming to the idea of a database but in my experience of life you never accept the first thing that is on offer and if you push for more protection concerning the data you will probably get it, and dont forget there will have to be two databases one with the performers full details including their address and the one where producers and fellow performers would access to validate the certs, it amazed me at just how many people were willing to sign up to this before they knew any details about it but with the correct security in place it should only be a good thing.

We have a meeting with two clinics and a cross section of the industry is invited. All spaces are taken now but believe me this is something that will be done in full view of the industry and an audio file of the meeting wil be available for those who want to know what went on as well and what has been decided.
...Flame throwers at the ready chaps.

I do hope that private clinics (mainly medilab in my case) will be a part of this process and debate, as you said nhs isn't for everyone, and I for one would not get tested anywhere else. Good luck with it all Terry and I look forward to seeing how this progresses mate.
