I think the point Phil is making is that R18's were only made legal by Judicial Review, not by any change in the law. Parliament can overturn a Judicial Review by enacting new legislation. Reading his entries on various threads over the past few months, I have come to the conclusion that Phil is one of those people who fully appreciates this. That is why he is always encouraging others in the industry to be responsible, and most are, in the UK at any rate. The legal situation is not ideal.

Cheers, I spent a bit of money and free DVD's with my Barrister and he felt the law has not changed, if you were unlucky enough to get a bad magistrate followed by a gay Judge you just might get yourself into bother. I don't believe in chucking the towel in either (I think I have proved that quite a few times) but I also don't like to send a lamb to the slaughter. For example do you know what trailers are on the film or phone adds, some I have seen have been stronger than the film. Point is we have perfectly good porn in the UK now and if you are a bit carefull it will always get through. As for the BBFC I would like to think I have a working relationship with them. They even rang the squad in question trying to help.

The story here is simple are we watchers of porn or marters for the cause,

There are two issues here: whether Solid Paul should try to determine why his DVDs were seized and whether a court might consider an R18 to be obscene.

Phil McC is absolutely correct in warning against testing an R18 in front of a magistrate or judge (or jury, for that matter). Although the BBFC considers DP to be perfectly ok, the majority of the population (who have never seen an R18, don't forget) would be left gasping in horror if they were forced to watch it.

The situation with Solid Paul's DVDs is somewhat different, though. A Customs seizure notice can be challenged informally, without going to court. Although I'm reasonably sure the titles would be given an uncut R18, as Phil McC pointed out, there could be extra material on the DVDs that would be considered obscene. Although it is wise to tread carefully, we should remember that Customs may have effectively stolen property that is quite legal to both import and own. Obviously, it's not my neck on the line here but I don't see the harm in at least determining whether Customs have made a mistake.
