To put it simple: buying via mailorder is not illegal, supplying is. And since we (and several of our colleagues) ship from with in the UK, the customer does not have to worry about HM Customs either, that's our problem.

I think your first sentance neatly sums up the legal position regarding buyer and seller. However you say that you (Your Choice I presume) ship from UK. Surely that is illegal whether you receive the orders and bank the money overseas or here in UK.
Please clarify - if you think you are legally operating, perhaps you would like to elaborate and presumably you would be prepared to supply the address from which you ship.
I have challenged the daft legislation here that prohibits mail order companies based in UK and selling to a Europe-wide customer base from selling to UK customers. In my view it is against the safeguards enshrined in the Treaty of Europe that prohibits individual countries from discriminating against competition from companies based in individual countries. It is a fact that, for example if Walt Disney wished to set up a Europe-wide mail order DVD distribution centre in Europe, there are UK regualaions that would (illegally) discriminate against them setting up their operation in UK. If they set up here, all their titles would require UK certification whereas if they set up in Spain or elsewhere, they could legally sell uncertificated DVDs to UK customers, provided the content did not contravene European or UK laws. This would be effectively an illegal fiscal barrier to trade. Now that hardcore video material is legal here (with exceptions of certain still illegal content), I believe it is against European law for UK authorities to discriminate against an international supplier from setting up here in UK.

Until another case like the PABO case reaches the European Court and gets a proper hearing the companies in the UK will face this legal discrimination. And it is going to take deep pockets to do that.

Thanks for all these recent comments too. I'm going to start buying it mail order like i said earlier and am confident there wont be any problems.
