It is a matter for the jury to decide whether or not photograph is indecent.
In deciding whether a photograph is indecent the judge should give some
guidance of what is indecency. The test most often cited is that of Lord
Parker (R vs Stamford)'namely offending against the recognised standards of
propriety'. It was also held in R vs Owen that in deciding whether a
photograph was indecent, the jury were entitled to take into account the age
of the child depicted in it.'
