Model Releases

I was gonna piggy back onto Tomsks post below about Marino and the policemen video but this is a general comment which is applicable to that title but also a number of others like the Abi Titmuss video and Pamela Anderson etc etc.

In these instances how is the issue of model releases and general model consent handled? In the "normal" porn world models sign a model released allowing the photographer/videographer to publish the content as stated in the model release but in these cases at least some of the participants have not given consent for it to be used in a commercial product so therefore do they (a) have a case to sue the distributors for publishing without their consent or (b) have a case to claim a percentage of the profits?

If they dont have a case then, to me, it seems that the whole model release malarky is really just a courtesy afforded to models rather than anything else and once someone has pics or video of you they are free to do whatever they like with it!

Truthfuly no release is needed. all this release stuff is for saftey. In the case of Marino they were open game simply because it was in a public place. If he had filmed it through a bedroom window would be different, other wise how do we get news.
With a model as long as you pay them or have an arrangement, a verbal contact is usually accepted. If it gets to court the judge will always side with the poor innocent model even if she has signed a release. As for Internet who governs it no one really so control is hard to imagine.
Best bet is always pay the girls even if it a small amount because they will always back you up with signing a new form or doing a photo id at a later date, most have for me,
