Help and advice removing myself from website

I would like some advice on a situation I am currently in.

Basically I went to a few dogging meets after seeing an advert on a website which was being filmed. However I was not aware that this was later going to be put on a subscription porn website. All of the movies have now appeared on the website which shows my car, little bit of my face and voice. Consequently some peope have now found out it is me and I want to get myself removed from the site IMMEDIATELY.

I contacted the producer who said he could not take it down and the website it controlled from the US so they would have to take the whole site down just to take some clips off.

I want to know what my legal stand on this would be and if there is anyway that I could get myself taken off the website.

Usually they need a model release to publicise any type of pics, stating that you allow them permission to sell/edit/loan/ 'do anything they want' etc, with them freely.

However......... You were dogging -I'm guessing in a public place?- so I think they're allowed to do what they want with them. You were also commiting an offence if you were in public, so legally you're screwed.

Maybe others can go into more details.

I don't understand that. Why would you have to take the whole site down?

Suggestion: compromise - ask for your face etc to be blurred.

You beat me to it Joe - might also be worth looking at 2257 i.e. model release and ID as required by US hosts these days.

My thoughts exactly.

Assuming that you was filmed with the old boy out, and given that they do not have a model release form they will be in Section 2257 trouble.

In simple terms, as I understand it (but I'm not an lawyer)...

They have no proof that you are over 18. If they can't prove that somebody is over 18 they could be showing under-age porn. Even if you look obviously over age that doesn't give them a way out. This is a criminal offence in the USA, first offence can mean up to 5 years in prison.

Okay thanks for your help. The shoots actually took place in Scotland so can this US law still apply?

If they have no photo I.D stating your age, then the US server that holds the web content is breaking the law. Of course, if they move the content onto a UK based server then no laws are being broken if you were filmed in a public place.

According to UK law, you have committed an offence, so I doubt any lawyer in the UK will take your case on except to rinse out your bank account and according to US law do you look even remotely young ie under the age of 18?

Its going to be difficult to contest this legally anywhere even if you didnt sign a model release. Imagine if you will pleading to a judge who shows the film to a jury and they see you wanking your cock into a models mouth. its going to be hard to contest you did it against your own free will.

As for model releases, i dont know so much about that anymore, especially when you consider Paris Hiltons video, Jordans video and most celebrities are splashed everywhere and none of these celebrities seem to have much luck even with the 2257 compliance in force.

In short, dont do videos at all if you dont want your face seen. More often than not, the people filming them are not the people editing them and will not give you special consideration as such.

I cant imagine why they would want to pull a scene off their website and do more costly work on it when they have loads of new product to go up. The harsh reality is: Do you think those people really care?

In this case i think you should put it down to experience. After awhile the fuss will die down and if you've been busted already whats the point? the damage is already done....its on the internet, downloaded by many and shared and forever out there in cyberspace. Taking it off the website is not a guarantee and a futlle exercise in trying to do so.

Sorry to be the harbinger of bad news but I felt you had to hear it like it really is.

May I ask what was going through your head when you attended something you knew was being filmed? Did you really think no-one would use the footage?

If it was in a public place, given there is no privacy law in this country, they can film/photograh you at will. Furthermore, you yourself admit it was advertised as being filmed. If you didn't want to be noticed why did you attend, knowing it was going to be filmed?

I would say you were very naive, but actually the word "stupid" sits better. Does your cock rule your brain?
