UK porn law

Hi everyone
I'm quite new to the industry so sorry if this seems a naive question!
I am aware that "extreme" porn and obviously child porn are both illegal but what else is illegal? Someone told me that a showing fully erect penis is also illegal but surely this can't be the case?

A fully erect penis is illegal on the soft porn channels and on tv of course.

The producing of hard core porn is perfectly legal as long as you don't outrage public decency, have verifiable photo ID's of all models that they are over 18 years old and finally do not attempt to distribute your finished porn in the form of a DVD or similar medium without it being certificated by the BBFC.
Having certificated your programme it can only be sold from a licenced sex shop. You could of course you could upload your material to website, but if you do this from within the UK it is deemed "published" and so illegal, even if your server is abroad.
Luckily, the UK authorities have a lot more important things to do than attack hapless porn folk. Of course you could like us choose to live abroad.

PS At present it is not permitted to show hardcore porn on UK TV and this is unlikely to change. This is policed by OFCOM and a TV station can be fined ?10's 000's even if they show a unpermitted shot, even when encrypted, which is a bit daft, but that's the UK, beat someone into a coma and get a small fine and a suspended sentence, show a bit of hardcore and get fined ?25,000 for each offence........!nuts!

It's not illegal to upload hardcore material to a website in the UK as long as it is behind an age protection barrier of some sort. If it were illegal, ATVOD would have invoked that law long before it issued its Rule 11 Determinations.

Hmmm, {rubs chin}. I guess that 'child porn' is illegal. But, 'extreme porn'. Hmmm. It is for a jury to decide if something is 'extreme porn'. Recent trial has fisting and penis sounding - items placed into urethra - as not extreme porn - possibly some scat in there. Hmmm...

Check out R vs Perrin 2002:
Of course if ATVOD worked within this, they would not be able to make piles of wonga, which is actually their sole purpose.

That's a bit different. That was an obscenity case - the material wouldn't have been legal wherever he published it. Adult material at R18 level is legal and there is no law against uploading it as long as it is age protected.

It was in the year 2000. I think that problem was the previews, because they were easier to see they became 'obscene' according to 1 (let me emphasise - 1!) jury found it obscene. But the scat inside was okay and not obscene. It was obscene because it was too easily available.

Im no QC, but I think the judgement is quite simple, uploading of porn from within the UK is deemed as publishing and us such illegal. It is simply a case of the authorities not bothering to enforce this judgement, as they'd have to arrest and charge thousands of people.
As neither of us are lawyers we must simply beg to differ on this matter.
