This is the worst case I have heard of.



Who do you despise the most, the cabbie or his solicitor?

I know what you mean Mart, the cabbie is claiming damages for stress and trauma, as he was forced into running this lad over, had the claim been against the highways authority(sp) maybe you could see his point, but as it,s a direct claim agains the parents, that makes him a cunt of the first order, and he deserves a good slap. His brief is just doing what all briefs do, leeching, he needs a kicking too!

Actually, the cabbie does have a right, all said and done.
As it was a RTA, and a fatal one at that, he would have been breathylised and his car checked incase of bad brakes etc. Once the police were satisfied the driver and his car were totally blameless would a verdict of accidental death be recorded. As the deceased was returning from a Christmas party and stepped into the road, chances are he was pissed to a point.
There s no excusing the callousness of the cabbies claim, but if I was in the very unfortunate position of killing someone who stepped out infront of my car, and I was entirely blameless, and my car suffered major damage and I was traumatised by cutting down a pisshead, I would also be looking for insurance from someone to pay for the damage, and IF it was suggested I was in line for stress related illness from the trauma I suffered, I would actively seek it.

sorry, that last line should read 'If I was in line for compensation for stress related illness from the trauma I suffered, I would actively seek it'

Also, the police would have recorded the speed of the cabbie by his tyre marks. If he was 1mph over the limit, he would have been charged for death by reckless driving

A bit of gun jumping here methinks

as Ace said the guy could have been pissed and been playing car dodging. If I was faced with the crap of having to deal with killing someone I might be fucked up. We don't know what shit this guy has gone through, anything from a breakdown to PTSD, he may never be able to work again, who's gonna feed his family?
We don't know all the facts here, and the factthat the claim has been settled without the family knowing suggests an insurance payout not a personal claim.
