F.A.O RGB (and photographers)

i sent you email a short while ago regarding my website - could you let me know when you have received it as im fearing for my kneecaps right now.

Does anyone know how the law works? its regarding being given permission via email to use certain content (and indeed he emailed it to me)then when the guy out of the blue at 1am threatens to sue you (but doesnt give me the information i NEED to resolve the issue) for using his work amongst other things said.

Im using this work on a few sites and have been for 4 months but as im a model and used over 20 sites in the past (some of which i dont even remember my passwords etc for) i dont know which sites have his work in them and he wont tell me where he has seen it!

Can he still sue me and make threats or does he have to give me reasonable information so i can resolve the problem?

Fist off if he has given permission - then he has given permission, but you need to know what that permission was for i.e. a website but not a magazine etc.

Secondly he should give reasonable information as to what the permission breach is. How can you do something about it if you don't know what is wrong?

Most people use a DMCA Notice now and this is very specific in terms of what has been used and where. And what you should do in response.

So find that e-mail, but also ask for specific information as regards what content should not be used and where it is being used so that you can resolve it. Now if he chooses to sue, you can be in a position where you have done everything you possibly could short of taking all of you sites down, to resolve the situation. Your soilcitor should make him look like a complete (insert expletive of your choice). Don't let it get into a slanging match on your part and keep every single e-mail. Who will look like a prat in court?

Also you could take all your sites down and counter sue for loss of revenue.

But I would reccomend going to see a solicitor. First session is usually free of charge.

Thanks for the advice - i was up til gone 3.30am trawling every model site ive ever used and removing the photos i found (with the exception of one site - the server was down and still is)
My website is out of my hands as rgb does that for me but i have emailed and asked him to remove that photoset.
Im not in the mood to play silly games with photographers who i suspect may have had one too many so i have just got rid of all the photos on all the sites i could remember (he still hasnt given me any info) - why should i advertise for him anyway? he was credited on every site and was getting lots of feedback from models and photographers - he can do his own advertising from now on and leave me out of it.
