TMZ headed to court over OJ Simpson book

The O.J. Simpson "fiction" novel, "If I Did It" has been stirring up controversy since Simpson first penned the fictionalized accounts of the murders of Nicole Brown Simpson and Ron Goldman. After a public outcry against the novel, the project was scrapped before it ever saw the light of day. Fred Goldman, the father of murder victim Ron Goldman, sued for control of the book and any and all proceeds from it. Now, another legal battle may be brewing.

Gossip website TMZ posted a manuscript of "If I Did It" on the Internet, immediately causing an uproar. Lawyers for the family of Ron Goldman, as well as a bankruptcy trustee, are arguing that TMZ should be held in contempt of court for posting the transcript on the Internet for all to see. In response to the allegations, TMZ and their lawyers have stated that the website did nothing wrong by posting the manuscript, as it was only available for a short period of time, though excerpts still remain on the website. TMZ is a joint venture of America Online Inc. and a Time Warner Co. subsidiary company.

In court papers filed on Wednesday, which were posted on TMZ.com, the lawyer for the bankruptcy trustee wrong that, "during the time that the Manuscript was published on the TMZ Website, literally tens, if not hundreds of thousands of people, downloaded the Manuscript, and now hold [the] property on their hard drives, property that is now freely transferable around the globe at the click of a mouse." The legal papers went on to claim that TMZ, "TMZ blatantly and intentionally violated the automatic stay." A judge had ordered that ordered the parties involved in the lawsuit not to disseminate the manuscript last week.

U.S. Bankruptcy Judge A. Jay Cristol said he would schedule a hearing for a later date to determine if TMZ should be held in contempt of court, and if the website could be held financially liable for any violation. The AP quoted Cristol, who said, "This may be a good thing rather than a bad thing," as he noted the parent companies of TMZ have "deep pockets." While the judge decides what to do with TMZ, O.J. Simpson wanted to clear his name and state he had nothing to do with TMZ's posting of the manuscript. The AP quoted Simpson, who stated that, "The book was stopped and the only people who made this book come back are the Goldmans and TMZ also profited." Simpson added that, "the book is out on the Internet, I wish they would tell me where it is."

Paul Battista, the attorney for the Goldman family, said that TMZ violated the court order that turned over the rights of the book to the Goldman estate. Battista told the AP, "I can't tell you how distraught the Goldmans are to hear that this hit the Internet for free." Brian Rich, the attorney for the bankruptcy trustee, called the posting a "serious violation" of the court order, stating, "We believe the estate has been damaged. This thing is out there." For TMZ's part, the company's attorney, Scott Grossman, stated that the website "did nothing wrong and we are not covered by, or in violation, of the court's turnover order.

There is more likelihood of Homer Simpson having killed them.
