When will we modernise the law?

Yet again 2 scumbags who having beaten an innocent man to death can get away with a manslaughter charge, because they can plead, "We didn't mean to kill 'im m'lud". The charges of murder, ie, the act of killing with "Malice of forthought" and manslaughter, being "An accident" are from days gone by, when scum didn't roam our streets dishing out violence as they choose.

We should introduce charges of Murder 1, and a new , Murder 2 charge, which is made if a person dies as a result of an act of unprovoked violence and the death occurs however incidentally. So, for example, if a pensioner is beaten and a couple of days later dies of a heart attack, the scum are charged with "Murder 2". Or if for example a weapon is used, in anyway, it is mandatory, to presume, "Intent to kill" and so if a person is stabbed, unfatally and falls back and cracks his head open, the filth get charged with "Murder 2".

A judge could then have mandatory sentencing powers, eg 2 X "Murder 2" terms and so on.

The "Manslaughter" charge should be reserved for deaths as a result of negligence rather than violence.

Shoot them in the kneecaps cut their bollocks off,far better than prison for this scum.

Cockney is correct, things like this are more down to the CPS warping the law in order to ensure 'a' conviction. There's no way in the tradional doctrine of Criminal Law that this is manslaughter as it fulfills all the 'mens rea' of murder, end of!

Saves money and it's a 'result'. Not really justice though is it !

I saw that on the news an thought it ridiculous too. In the States if someone accidentally kills someone in the act of a felony, a burgulary for instance, the felony-murder rule bumps up the manslaughter to a murder charge.

That case and ruling was just ridiculous.
