legal question-model release

ok, i have now filmed my first model!!!
It was nothing major, a local lapdancer stripping down to nude and then holding open etc.
Problem was I didnt get a model release because she doesnt want it being commercially released. Imvery annoyed at this because she didnt tell me this until after the shoot and after id paid her.
My question is what can I do with this tape now? Can I show it to my mates?
My reckoning is that as long as i dont charge for it i can show it to my friends etc as im no `commercially` releasing it.
any thoughts appreciated.
andy
p.s i really want to show this to my mates as they dont believe me!

You can do what you like with the tape. The lack of commercial release is only a problem if you want to make money out of it.

Paul's right. You can show it to your mates privately, but the minute you try to sell it, you're in deep water. I'd caution against swapping it or copying it was well, because if she complains and takes you to court, you'd have a nasty little fight on your hands.

No ID, no money. That's the way to do it. Always establish up front what you want the girl to do, how much it's going to pay her and get the ID shots done up front (it's always worth getting the girls to bring along passport and driving licence and doing a couple of still images to back up your paperwork, because the Yanks like it all neat and tidy).

The answer is yes and no.

(1) regardless if you have a model release or not, the tape has not been through the film censor board and so you cannot show or disribute the tape.

(2) most people only shoot for there own use, so she is fair to say she does not want to have the tape shown about. You should have stated this before the shoot. In my mind, if you do distribute the film, after she said you did not want it to be, then you are not a gentalman. Whatever her reason (ie she may have children) are her own reasons.

Keep the tape and watch it in private. That after all is what you agreed with her. To show this to others shows that you have no regards for another person, regardless of there occupation.

thanks for the response,
I do not intend letting the tape out of my hands, I will just show it to my mates at my house and that will be that.
Last q, if I gave away copies for free-is that illegal?
thanks
andy

I dont agree, i believe that 'publishing' covers showing the tape to a 3rd party (ie anyone but you or the model) If she can prove you have shown it to others, then I think its you who are in breach of the 'contract' you agreed with her. Im not sure it has anything to do with money, purely the signing or not of a release form. I need to add im not an expert, but have tried checking up in the past
