Debts wrote off by Distributors

How many other producers have lost money due to Rude Britannia writing off some of its debts from its customers? we were told today that we will not get paid money owed to us for a period of time because they wrote it of as a bad debt but surely this most not be our responsibilty as they sell for us & we wasn't even consulted first.
What other distributors use the same practise & you would think that we should be able to choose for us or them to take action against these bad debts that are owed to us & other producers instead of being kept in the dark. We will now need details on whats owed from where so we can try to recoupe some of the money legally or sadly otherwise.
We get asked why producers don't make more films so to any customers seeing this page they will know why.

As you guys know I lost a small fortune due to these guys, and caused me a lot of hard work convincinng the sex shop owners that our product could now be trusted,

It would very much depend on the terms of your contract, however usually reseller contracts do allow for the deduction of bad debt.

There are however 3 important caveats:

The reseller must have exercised due care i.e. trade references before selling on credit etc

They must have made reasonable attempts to recover the debt.

They must have acted in good faith i.e. not written off affiliate company or their acquaintances debts.

Usually you have the right of audit to confirm the above.

Yes Marino you did warn us but we expected companies to be honest with us a bit, we live & learn.
