Disclaimer form

Do any one have a copy of a disclaimer form that the coulds kindly pass on to
jonnystyle@hotmail.co.uk
Form will need to confirm that all pics taken by the signer is not for re-selling and for there use only

Signer sells nude pics of now famous WAG to tabloid for ?50,000.
WAG sues. WAG produces copy of letter that says :-
"I confirm that all pics taken by the signer are not for re-selling and for their use only"
Goodbye ?50k, and costs etc.

This is becoming more and more common with models doing 'private' material, I know a few 'glamour girls' that do harder shoots for private collectors, but require a disclaimer that says.
Said video/photos (description of, length of, etc) produced or created on X date, are for the sole personal use of Name, and not for resale, this isn't ideal tho, as it only covers resale not posting it on pornotube for free, so the better ones include ALL use other than personal viewing.

It shouldn't be too hard to write something that covers the agreement between model and photographer, it's basically the opposite of a Model Release.

Hi
Models should be awear that such disclaimer forms, are generally worthless! If they are that concerned they should either not do the work or get paid an appropraite fee.
Even if a model sues - the model would have to prove damages, legal costs would be massive and probably prohibative.
I am sure many will disagree with our statement, but really in this country such "contracts" are rather weak in law.

Actually I agree.
The WAG case is easy - the damages are at least the payment made.
But if they were sold for less money to a small site before she became a WAG, but it was only noticed once she did become one, and tabloids ran with it, it gets really messy.
Models shouldn't ever do anything that they don't want known about, but as long as it's not supposed to be secret then a private use only keeps them low key.
