If the Royal Mail is sold to a foreign company will this create a loophole to send uncerted material through the post, its not illegal to send bits through private firms so in theory this would be the same.

The Act you are referring to is the Video Licensing Act, and the Royal Mail isnt being sold as more someone else is buying into (the government still having the controlling share).

We understand the Video Licensing Act but the Mail online is now talking about a total sell out which should create loopholes if this is correct, below is a snipit from the mail...
"Mr Cable said a review by an industry expert had identified an 'urgent' need for a fresh injection of billions of pounds of capital, which could only come from the private sector.
He later told the BBC: 'We are not proposing to keep a Government stake.
'The Royal Mail will become privately owned and there will be a share for the workers within that company."

I doubt the the Act involved will review the position, which means that the only way to find if a SUSPECTED loophole stands up is for some crazy deep pocketed volunteer to be a test case.
Your lawyer - since the Royal mail has been sold, the rules have changed.
CPS lawyer - the royal mail is still the royal mail in terms of function, the rules relate to function, so they haven't changed
The judge - "you mean people still send porn through the post? I get all mine through tube sites. Oops, strike that from the record"

I'm sure there would be 100's of people testing the water if this goes ahead, in the continent its legal to post any material so depending on who buys & the Governments involvement it could change things.
A solicitor friend is looking into this but won't be able to tell us correctly until sales have been made etc.

Won't this just be like Subscription TV. There are foreign companies running Subscription TV channels, but there are still "restrictions" on what they can show.
I'm sure the government will fudge the legislation somehow to maintain control.
