Hi Ghostdog and Everyone,
You this really does get on my TITS!!!!.
These wankers from Liverpool Trading Standards should be sacked for bringing a case like this to court.
O.K. if they were prosecuting a Company/Individual for importing or distributing really offensive material (Kiddie Porn, Bestiality, those types of things) then i would fully support them.
But as with the motorist's and speed cameras they always look for the "Easy" prosecutions, not forgetting they are spending public money on persuing this case.
There is a notorious Car Boot sale near where i live, now i bought a Few Movies off some traders and over half where rubbish. Now i know i did wrong by buying pirate adult material, but these guys are blatantly selling all types of software. After having a discussion about how rubbish their products are they told me to "Go Forth And Multiply" No Refund.
So i contacted my local trading standards and told, nothing has been done these guys are still here still trading, Unbelievable!!!
Perhaps TS can't be bothered getting out of bed on a sunday morning, but i tell i would Fuck All these Officers off working on this Liverpool Case.

Mail order R18
Re: Mail order R18
As the great scholar say's "Anybody who said they are a Brain Surgeon are really a Taxi Driver?"
Re: Mail order R18
I do agree with everything NOBBY says. The situation regarding R18 and mail order is irrational. However it is often forgotten that we only have R18 by Judicial Review. There has been no changes in legislation.

Re: Mail order R18
Yes trading "standards" behaviour is often substandard and not clearly focused on the real issues of public interest but it is also worth baring in mind that this is a test case. If won it might well have a very benificial effect on liberalisation of the R18 market. Of course if lost it would be seriously bad news...

Re: Mail order R18
So this could go all the way to the House of Lords or even Europe then?

I suspect that Pabo will win out right and that will be that, but yes it could go a lot further.

More likely, they'll say 'stuff this for a lark', and concentrate on their hassle-free European business.

Re: Mail order R18
Bad news the story from the inside is they are going to loose. The PABO case is quite different and they may win, The reason they will loose the first is simple this judge will not over rule an act of parliment however much of and ass he thinks it is. And he has already gave comment on this, going to the house of commons on appeal as far as I am aware is not permited as it is a trading standard offence (I could be wrong on that one but it seems to be the case) and just to spoil it even more going to Europe is a waste of time and money as Mail order of hard materials in Germany/Belgium is illegal there also. Believe me. They should have pled guilty at the start and posted from Europe all that will happen is theyt will loose and trading standards will have a cull on the mail order companies. Posting from Europe is perfectly legal even if the transition is done in the UK provided the product is 18R. I do it and have had a serous raid in the past and got everything back.

Re: Mail order R18
I don't think any Judge would over rule an Act of Parliament unless there was a conflict with another Act - as there often is which requires him or her to pick between the two. I believe the VRA makes it an offence to supply R18 through the post, but the question must be when do the goods become yours? If they become yours when the money is transfered then the postal leg is not part of the supply because you own them already.
