Interesting comment from David Lever re shooting "soft" material, he says that for the sake of reality all shoots are the real thing but with camera angles only showing soft views, by implication this means that during shooting of the 18 rated (soft) Teresa May video "Teresa Takes 10 Inches" she was actually being shagged by Marino & the answer to the oft raised question "does Teresa do hard core" is yes, but it has not been released.

Legislature always seeks to define acts in terms of what happens but in the real world it's more the process and context that makes the difference. Its not really about whether a penis is erect or not, it's about how it's being used. I prefer to distinguish between the depiction of real sex and sexually arousing material - not a textbook approach perhapos but it helps stop me get too hung up on definitions based on details. For example, just holding an erect penis as part of a photoshoot is softcore in my book unless it's being held in the process of giving the guy a handjob or as prelude to a fuck. Many models would prefer to keep their sex lives off the camera and would not wish to be seen having sex publicly, but would still be OK with holding a man's prick and posing in provocative fashion.
The same applies between masturbating on camera and just holding a pussy open or pretending to masturbate. One is sharing something incredibly intimate, the other is just a pose, no more.

As producers try to get as close to the line as possible a different sort of content has emerged, its not softcore and its not hardcore its... tellycore! It sits right on the boundary between soft and hard mixing different parts of each, but this type of content is not likely to remain with us for long. I predict that by next year we will see a return the the more traditional diffinitions (traditional hardcore on subscription services and traditional softcore on other services).
From my understanding, a Penis, whether it be Soft or Erect, inside a persons Mouth, Vagina or Anus is indeed Hardcore.
A Penis, whether it be Soft or Erect, being held in a womans hand, is neither. It used to be a case in the UK, that an Erection was NOT ALLOWED to be shown in Magazines, Video's, etc, but that has changed.
