Despatch vids from within UK mailorder but ONLY abroad not to UK.
Perhaps only in NTSC.
Presumably onus on seller to prove no UK sales, or not even a
starter ?
Likes of Marcus A.,Phil Mc could probably give a more definitive
answer than any lawyer I suspect.
Suppose I could always move to Spain.

The law as my legal see's it is it is against the law drawn up by the BBFC to mail-order 18R tapes, it is against the law to mail or sell anything without a certificate, hence Bobs recent missfortune at the hands of the law.
The ways round the law are.(which I am sure you want to know). 1. The big guys operate a "agent bought in a licenced sex shop system" which means they take your money go to the local sex shop buy you requested tape and then post it. No law broken as far as they see.(no prosecution has been made against them.
2. Bank the money in Europe, or post the 18R from Europe one or other breaks the specific UK mail-order claim by BBFC.(NOTE TO SEND UNLICENSED VIDEOS FROM EUROPE INTO UK IS ILEGAL IN THE BOTH COUNTRIES).
3. Deal only with trade customers (if you claim to me to be a video/dvd reviewer and sign a form to sy so I can not only supply you legaly I can supply you at trade discounts. By the BBFC's own guidlines trade people are exempt from the licensing anyway.
Which way is the best you deside. I would expect the law to change at some time to allow mail-order simply because you can mail 18's and I beleive there should be no restricted 18Rs. what you are watching right now on BBFC 18 should be 16 cause its far to soft,

I don't think you are right in your suggestion 2.
From UK we can send un-certificated materisl to Europe. It is up to the receiving countriy's custome to allow or confiscate. They could charge the person who ordered, but obviously not the sender as it's outside their jurisdiction. Similarly, a European supplier cannot be expected to know every country's laws and can send tapes to the UK if ordered from UK. The person who ordered may find his goods confiscated by UK Customs and could (unlikely) be prosecuted. However there is no way the overseas supplier can be charged (unless he is breaking his own domestic laws). Speaking with Customs, you will find that they WILL NOT confiscate anything from Europe unless it is grossly obscene, whether or not it has a certificate, unless it appears that you are importing them for trade rather than personal purposes.
You are therefore OK ordering from Europe (and to a lesser extent US) unless grossly obscene.
