I think the not proven verdict, which I once delivered as part of a jury, is our way of saying the prosecution team hadn't done its job properly. It's not acquittal, as such, but more that we cannot say 100% that the guy did the crime he's facing. We also have 15-person juries. Sometimes, though, even without the full evidence, a jury can convict.
About 15 years ago, a couple of guys were doen for the murder of a gunshop owner. CCTV camera evidence placed their vehicle at the scene, but only one of them went into the shop to commit a robbery and shot the owner while the other was the getaway driver. In court, each blamed the other. The jury, following some helpful advice from the judge, found them both guilty of murder since whichever of them stayed in the car knew the other one was armed and what could happen. A common sense approach.
We don't have a Crown Prosecution Service. Each area has a procurator fiscal's office, which decides on whether to prosecute a case, what charges and so on. In the end, though, we have the same mix of good, professional people and utter incompetents that exist in every law system in the world.
Sorry about the ear slashing. I'd have been inclined to report it, no matter what. As the bloke has settled down, though, maybe things did turn out all right.

Oh, and I think you're right about the sentencing. Ten years for that seemed totally inadequate. The Lord Advocate might appeal the sentence a few months down the line, as he is doing over the Lockerbie bomber who was sentenced to 27 years (a pathetic sentence if he was guilty of the crime).
