First of all. What an excellent site this is. Hats off to all concerned.
Secondly, I know that various aspects of this topic have cropped up before, but it still seems somewhat confusing. Or maybe I'm missing the point.
I understand that R18 films need to be sold from a licensed sex shop and that mail order of said films is illegal.
So what about all these model sites, many of them UK models which provide access to hardcore clips via the net and also sell hardcore by mail order?
Is that legal? If so, where's the logic?
If its not legal, what are the chances of getting busted?
Any clarification would be more than welcome

Before I go on, what I am about to say may be wrong, but I think its true.
(1) R18 films have to be bought from lisenced sex shops, apox 90. You must collect the films by going into the shop. (This is UK).
(2) The net is not covered by the UK film sensor chaps (well it copuld be but a pain in the ass to inforce, ie the sites may be UK but the server the films or stored on are may be in the USA). The film senser covers only moving shots, so stills are nothing to do with them, so vhs, dvd's, film, advertiments, computer games are uder there cover. I think TV is different.
(3) Most sites just have short or low quality clips on them, but maily photographs.
(4) Yes, you will find lots of sights selling porn that has not been cleared through the uk film sensors. Some people think its ok to do this. All it takes is somone who does not like you to make one phone call and the next day the people selling the films will have there gear taken from them, I am not sure if you would be prosecuted as well.
(5) It has also to be noted that in the last few years that because porn films have been made 'legal' that photographs are now more legal too. Ie, a bit back full sex shots were a no no, today you have less fear of being prosecuted. You can get full hardcore magazines now in the UK.
(6) We are still under the 'obsene' rulling, ie, the mail cannot carry obsene material. The question is, is what is obsene. I have asked police, solicitors and so on, as yet, no one can tell me what is obsene!!!!
(7) Porn is not the only thing to have problems under the film sensor board, today we have problkems with having spiderman clased as a 12, when people are saying make it PG.
(8) In my mind the company that does the film sensor board in the UK is just a money making machine. I do not feel that its aims are to help people, only to make a profit.
(9) As the internet speeds up, and as you will be able to store large files, ie full films, on the net. Also as internet TV becomes more popular, I would guess this will have huge impacts on the film sensor board.
These are just my thoughts.

By the way, if you are thinking of selling porn (vhs, cd rom, dvd and so on), its not worth it, as it only takes one person to make that call.
Do not foget that the local councils earn 40k every time a shop gets a lisence, so if it finds someone selling vids illigall, its going to jump all over them.
In some ways the councils are akting as legall mobsters, collecting 40k each year from shops. Like all mobsters they look after there investment. So you sell vids, see how lonng you last.
The other thing you must note is that if you make a film legally, spend the 2 or 3K to get it though the film board, you have only 90 or so shops to sell it to. Because there are not many shops, you do not have the power to sell the vids to them for a huge amount, ie, you may sell it to the shop for ?7, but the shop can then sell it for ?40 or more. They can even buy it back and re-sell it again.
With luck this may change in the next few years.

My views on this.....
Hosting hardcore porn - as long as it is legal and not hosted in the UK (which most are not due to cost and the legal position) you should be fine.
Selling uncertified videos - anyone selling directly from the UK is taking a hell of a chance, plain and simple. Get caught and you will get done but I suspect the penalty would not be too extreme as long as the content was legal.
Chances of getting busted - impossible to say really. You could do it for years and never get caught or your first customer could be PC Plod, its part of the risk.

The Melonfarmers web-site has lots of interesting reading
material on the BBFC. They have no remit to censor internet
content, but even if they did have it is not clear what the
enforcement vehicle will be, since most of the content
and distributors live outside of our jurisdiction.
What will be really interesting to see is, as broadband
comes in and the internet speeds up, it will be increasingly
practical to stream quality video to the home over the internet.
This is going to shake up the movie industry in the same
way that MP3 did for the music industry... and it will
have some massive consequences for the adult industry and
groups such as the BBFC.
Whether the UK government will tolerate this and whether
they can realistically put a stop to it are two very
interesting questions.

(2) Yes, broadband will make changes. I would think that if the net does go under the law, it will not be the film censer, rather I suspect the same rules as TV. But I do not think that due to the cost legally to pursue people who run internet TV shows, that we will ever see any involvment withThe other side will be, will internet TV get linked to your home TV ansd such allow you to watchg the goverment.

The cheapest option, which a lot do now is stick a web cam onto there pc and turn it on from time to time or leave it on 24 hours. The next is to plug in a digital vidio camera for high quality (tv quality), then you go onto the high end such as big brother and plug in seeral cameras and even allow people to remotly move them.
