Illegal Bank Charges

A while back i posted that i was going to take my bank to court for stealing money from my account for what i considered to be illegal charges for a direct debit payment that didnt go through because of their delay in clearing a cheque, before taking court action i contacted the Finacial Ombudsmen to see if they could get the Bank to see sense, i have today been informed by the Ombudsmen that the legal issues at the heart of my complaint have been referred to the High Court by the Office Of Fair Trading, the test case may take some time to resolve but will clarify the legal position as to wether these charges are legal or not, if the Banks lose this case it will cost them millions in compensation they will have to pay to people for the money they have stolen from them !cool!

And then start charging for your account, charging for every transaction, charging for replacement cards.......

The Banks will always win.

They're winning anyway, but they need putting in their place.
Anyway, think about it: if so-called 'free banking' (no such thing) is lost, they will all be vying for each others customers by offering deals....

They're locking them up today, they're throwing away the key...I wonder who it be tomorrow, you or me?

Apparently everytime someone has started court proceedings against one of the Banks for these unlawfull charges the bank has settled out of court because if a judgment went against them they would be fucked, the Office of Fair Trading is seeking a Judgement in the High Court because the Finacial Ombudsmen has been so overwhelmed with complaints it would take them years to deal with them.

I argued with the FS Omb. that fee-charging ATMs had no right to exact
the full [usually ?1.50] amount when due to a cash-shortage in the
machine one only received part [or none] of the sum requested. Failing
this, I suggested a menu-option be inserted detailing the amount available
and asking if one wished to proceed [and pay the fee] or abort [and not].

Their response was essentially "tough'- it's in the card's small-print and
there's nothing you can do, or we care to do, about it".
You can imagine how I feel about the efficacy and imnpartiality of the FS
Omb....

I did that.... got 5.7 back from Lloyds just before a court date was allocated
