It's clear in the report that there is a breach of trust issue. Basically he 'groomed' the girl. Would you want your son or daughter in a college or sixth form vulnerable to predatory members of staff who believe they're untouchable because the kid is over 16 ?

It's not consensual in an adult to adult sense when the guy knows which buttons to press to make her feel special and get what he wants. It's exploitative and it's only right there are consequences.

The law in Scotland can differ from England. This might partially explain what appears inconsistent. Also the two cases may differ in that in the woman's case there may not have been evidence of 'grooming' over a period of time - no emails, text messages etc as there was with the music teacher. That's a possible factor.

The law is an art and not a science, and there are all manner of inconsistencies. Perhaps the Scottish system takes more account of impact statements - which the boy's mother provided - when sentencing ?

What the two cases have in common is that an offence was committed.

The law is clear in the matter when someone is in a position of authority/care, then aoc is 18. He must have known the situation was illegal, so he deserves his sentence.
