"It was an accident. Yeah, he shouldn't have been driving and he killed someone. He should be dealt with by the law.
Would deporting him just punish his two kids (who've done nothing wrong)?"

Let me see, he was a serial offender with convictions for drugs possession, burglary, harassment, criminal damage and theft along with a string of driving convictions, I don't see how his wife enters into the story, it could be that she has no conviction's-we don't know actually, she may, but she didn't kill this guy's daughter.
He says if he was deported he would be deprived of his right to a family life?
the only person deprived of a family life is the guy who's daughter he killed.
He should be deported and his wife and kids given the choice to go with him or stay, the two appeal court Judges should quit the bench, as they are clearly unhinged.
On a more personal note, because I am aware deportation won't happen, I can only hope he develops Cancer, frankly he's a cunt.

If you ask a traffic cop he'll tell you that there are very few road "accidents" . A high percentage of road incidents are preventable. If this fucker had not been driving illegally there would not have been the murder of an innocent child. So the accident theory doesn't wash.

Surely a major problem with this case is the totally inappropriate and inadequate punishment once again handed down to a motorist who killed someone.

No. It would punish him. He has a string of convictions and left a little girl to die under his car while he ran off. A suitable case for deportation of a failed asylum seeker, I would have thought.

The only reason that he was not deported in the current situation was that it was regarded that he "had a right to life" and a "right to a family life".

Given that there are sizeable Kurdish communities ( he's an Iraqi Kurd) that control various parts of Iraq, I do not see why this "right to life" argument is valid re. a return to Iraq.

As to his two kids and their mother, apparently he doesn't live with them anyway which rather throws the court arguments of the "right to a family life" into question somewhat.

We also need to remember in balance that his actions destroyed the only child that the little girl's parents had. Their right to have a family relationship with their kid has been destroyed through absolutely no fault of their own.

He has clearly done enough damage to the society which initially welcomed him with his cowardly, criminal behaviour including leaving a little girl to die.

Cheers

I think all fair-minded Brits are agreed - deport the swine and let him
make the best of it in Iraq. He has several criminal convictions in UK.
Let him try the same in Iraq. Someone will deal with him via a bullet
in his brain or backside in that jolly place !

Part of me accepts that having kids shouldn't mean you have a licence to flout the law whenever you feel like it but another part does think it's punishing the kids. I don't think there's a definite right answer and I'd have to know more about his recent relationship with his children before being surer of my opinion on this.

I mean, in a society where 40% of marriages end up in divorce, what constitutes a 'family life' these days? Many broken marriages still consider themselves a 'family' whilst the kids are still adolescents.

I'd argue that your average divorced husband sees more of his children than your average aristocrat that has a nanny bring up the toddlers before shipping them off to boarding schools throughout their youth.

Like I said, I've no definite opinion on this.

I cannot understand why there is not a clause in the Human Rights Act that enshrines an individual's right to:

"Go about one's life in safety and under the protection of the forces of law and order"

It would then allow the innocent individual some recourse under the Act against the filth that control our streets and also the police for renaging on their duty to ensure our safety.

It would also be a balance against the abuse of the Act by villainous scum.

You'd see how quickly the police came around to your house when under siege by yobs, if you could claim subsequent compo against them, by citing the HRA.
