As it is illegal to send porn through the Royal Mail I take it you can't legally send stuff through the post to BBFC for rating....

I wonder if when they de-regulate the postal service fully if the laws will change any.

I mean if a huge Adult Video company went upto say Initial Postal Services and said "I'l give you 300% postage to deliver my goods but still only charge customers 100%, I'd bet they would challange the ruling and zsee ???/$$$ signs :)

And does the law only apply to Royal Mail? Is it legal to use one of the courier companies?

I'll bow to somebody else's superior knowledge here but I don't believe that selling films of R18 strength is an offence by sending it through the Royal Mail. How can it be deemed offensive, indecent or obscene if a government appointed quango has it given it a certificate?

I don't believe it can but then I'm no lawyer or legal expert.

As for sending it by private courier then it was widely believed that this was a legal loophole exploited by David Sullivan a few years back.

The offense is caused by selling R18 content outside of a local sex shop but as I side I'll bow to somebody elses superior and more recent knowledge.

Funny but you can sell them on the net to anyone with a credit card as the credit card is assume dto prove age, yet you can ship it wit the same ID

I think that something can be seen as obscene or indecent even if you bought it legally and I think that it is illegal to send R18 stuff in the post.

There was a similar post a few weeks back. Customs were impounding stuff brought into the UK although it was legally bought in the UK in the first place.

Well I'm no lawyer but I would think a first year law student would be able to win a case if the authorities deemed an R18 film to be obscene.

As I said it has a BBFC certificate and is therefore, as I understand it, does not come under the obscene publications act so how can it be obscene?

That would surely be an easy one to win in Court wouldn't it???

As I said before I will bow to somebody elses more recent and therefore more informed opinion as my dealings with the old bill and the OPA are a long time ago.

Ok

So there is a law that says you can't send R18 dvds in the mail or mail order.


Yet there are tons of websites on the net that sell porn like that aren't there??


There is a website called cd-wow.com that sells R18 porn dvds and posts thme, at cheap prices to.

Is it risky buying from them as its techinbally illegal form them to send it and so ur dvd might never reach you?
