Advice needed please

A website is using a video download that is my copyright without my consent.
This is their reply to me.

'Please note we ONLY purchase content from reputable sources and it MUST come with the proper model releases and 2257 agreements. We ONLY use authorized content. Please reply with the actual show (URL included) you are referring to and we will then forward your email to the correct department for investigation.'

I have done this. What are my rights and how can i have it removed?

Whilst this refers being registered with the UK Copyright Service, it explains the procedure you should follow.

The magic word you are looking for is DMCA...JoeA would most likely be the best one to ask about it, as I believe he has done a few of these on folks ripping off his content before.

If the site itself is giving you short shrift, just go further up the chain and take the matter up with their host....a DMCA is no laughing matter, especially when some of the more creative legal types are now pushing the argument that each frame of a film constitutes a separate illegal image use. At 24 fps, even for a 30 second teaser clip, is 720 frames...lets say a nominal fee of ?1,000 per illegal image usage = ?720,000.

Just threaten to use the magic word, and suddenly folks will become a lot more co-operative, which might help you track down whoever it is who is selling your rights on without permission....

Do you know the name of their host?

This is one way. In this industry there is so much copyrighted material, We have managed to get quite a bit removed by locating there host/s and going through this route.

As all hosts have a duty to monitor whats on there server. Finding their host is a relatively easy thing to do,

Thanks for all advice.
I am waiting for an email back from a company with, hopefully, a resolution to this matter.
I have also contacted the hosting company of the website involved, but I am now finding images on other sites.

It's a laff, innit?

An update.
I would really like to thank Joe for all his help in this matter.
His help has been invaluable.

The original website has removed my images, but they are now popping up on other sites, but a DMCA soon solves that, although one server company seems it is funny to ignore three DMCA's issued.
