compensation act fao marcus allen

Post by zasuna »

Marcus while i don't know anything about your mates case,i do know that this law is in place to protect us from "the Black market" ie fags, booze, drugs, porn, cars, and other stuff people can import and not pay tax, duty etc on in this country.
yes we all agree these things should be cheaper in this country but the law is there to protect us from duty evaders and the like who pay no tax, infringe copyright, use cheap labour, cost us jobs, make us pay more tax,and generally make a living from the black market.if he was found guilty it is us the british public he is stealing from and therefore i think a fine is in order i'm sure you must agree with that, how much, well that is open for debate.
on another point, you make your vids in the uk,use uk girls (do they send entertainer forms to the tax people?),i assume you edit them in the uk and you sell most of them through a company based in amsterdam (your choice), and you say your company is based abroad.my point is for a product made and consumed in the uk no tax, vat, duty is paid here so no wonder mr blair and chums are not too keen and c and e are so interested.of course hc should be available in the uk and i think it is only a matter of time before it is.but when it does become legal will it end the rip offs, tax evaders, cash in hand, copyright infringements i for one think not.
and one final rant the bbfc does not make the rules on what is obscene the govenment of the day does.so why does everybody complain about them write to tony and let them get on watching films?

I entirely agree with most of what you say Zas, however, all of us in the industry are helping the economy in one way or another. Taxes-the obvious ones and hidden govt ones as well. We are not accused of hurting the treasury, merely that (in some cases) we sell product that has no BBFC license. It has been said many times that this mob should be scrapped and any prosecution should only ensue if a filmaker transcends the bounds set i.e. R18 standard. Why on earth should we not sell to whom we choose-we dont coerce buyers-they come to us as willing participants. The true OFFENCE is not the content, but who we are selling it to. There is a little matter of restriction of trade.

Zasuna, Ill tell you how Sullivan gets away with it. For years his companys have been selling soft 18 cert stuff (softer than whats on Channel 5) which he buys in cheap and then advertises as hardcore to fool the punter into parting with his cash. He should have been done under the Trade Descriptions Act for false advertising claims but the authorities left him alone and targeted the small honest(ish) guys who were selling the "real deal" instead. The choice was either treat your customer fairly and risk jail or rip your customer off and be left alone by the police. It makes me bloody furious. I agree with your point about tax evasion etc. I often wondered how the government can ask for tax from what is essentially an illegal product i.e. non certificated videos.

What next? Are they going to use the Compensation Act against prostitutes who also pay no tax and are part of the black economy? I can imagine a huge outcry from womens groups if a prostitute was ordered to hand her house over as has happened to Marcus friend.
