Porn by Post

Post by Rock Charogne »

Can anyone confirm:

1. OK - it's illegal to send porn by post - does that only refer to the GPO or does this cover the various courier services eg fedex etc ?

2. Illegal to send to UK addresses, as I understand it, what about foreign addresses ?

Thx Guys

Rock

I'll bow to somebody elses more informed opinion as it is over 5 years since I worked in the porn biz but I believe that as long as you are sending R18's then I don't think it is illegal to send it through the post.

The law prohibits the sending of obscene material and as it has a BBFC R18 then it can't be deemed to be obscene hence it isn't illegal.

The law that is broken is that they can't be sold by mail order.

I will stand to be corrected though.

It's illegal to sell R18 through the post in the UK, but you can sell it from an address abroad, which is why all the legal moves have been made recently.

It's not illegal to receive an R18, but it is illegal to supply, because they can only be sold in, not from, a licensed premises.

I might be nit picking here but I don't think your are absolutely correct.

It is illegal to sell R18 content films from anything other than a licenced sex shop hence mail order is illegal but the act of actually sending them through the post is not illegal as it is only obscene material that cannot be sent by that method.

That might be a technicality but it is how I understand it. In fact I have been speaking to a company who sells R18's and they have an agent in the UK sending the R18's out although the company is based abroad. They claim the agent is breaking no laws and nor are they themselves.

They might be talking shite but as I said I stand to be corrected.

You aren't allowed to send anything pornographic at all (anything containing nudity) through the Royal Mail. Using another courier is allowed, but not the Royal Mail.

As far as I know, the old law was that you could supply R18 DVDs by mail as they were being "agent purchased" from a licensed sex shop then being sent to you after the act of purchase. The new law means that the actual transaction must take place on licenced premises, so no more mail order as far as I'm aware.

So, seding porn through the post (as long as it's not by Royal Mail) is fine, but buying it by mail order is not (I don't think you'd get in trouble for trying to buy it, but the company selling it might, unless they donate to the labour party or something).

Well this one is interesting though I will say sorry to all fellow prodz for going over old wounds.

The law has nothing to do with royal mail, fedex, securicor, buisness post or any other mail delivery company because it's aimed at the delivery method not the company opperating the service. If the law outlined a company Jonny Bollix could jump in his car and deliver porn all day but if he does he'll be out side the law.

The OPA forbides ANY adult orientated material from being sent through ANYONES mail box as it could be oppened/recieved/viewed by a person/s that may deem it offensive or of an un lawfull age to view such material.

There is a European angle on this which is basically that a European company importing material is allowed to do so because internal adult publication via mail is allowed in country of origin (outside OPA). So if the British censors block their mail they are restricting buisness practise blah blah blah. However internal British companies opperate inside the OPA.

It's mad it's bonkers it's barking but again it's BRITISH!

Steve that's nothing to do with your Postie being suspicious more likely a thieving git or 'damaged in transit'.

Your normal everyday Postie can't open anyone?s mail it's a sackable offence - 'tampering with Her Majesty's mail' and the excuse they were looking to see if there was anything suspicious in the item wouldn't stand.

The only post office people who can open your mail is it's security department and if it did and found porn it would go all out to prosecute the sender and want the items as evidence.

BUT The only way they could know if the items are suspicious is if they are part opened and someone could actually see anything porn related to take things further or if something from the sender had come to their attention and they checked all other mailings for similar items.
