Getting noisy neighbours evicted...

I have a noisy bastard living above me and all I hear all evening is chatting, laughing, stomping around, loud TV etc. It goes on until 2.00 or 3.00am each morning and I challenged him about it recently. He said that he is a student and students make noise (?), and how it is inevitable that if people come round to visit him then I will hear them (double ?). That is like, if I was a heavy rock fan and my neighbours complained, me saying "But rock fans are bound to play their music loud arent they" and expect the complainant to just say "oh, ok".

I own my flat and this guy upstairs rents his, he also has at least one other person living there (a mate who likely sleeps in the lounge) and they chat and stomp around all the time. The owner seems unaware of the other person living there (I have met the owner a few times). I would imagine the owner would be none too keen to evict the guy as he will be cutting off his own income, which he presently gets from letting the place out, if he kicks the guy out.

I also feel that if I complain then the guy upstairs, and his friend (or one of the others who are always round), may take some kind of revenge on me - not physically but maybe giving me even more noise, dumping rubbish outside my door, and so on. What do people think I should do? This is very annoying! Please also detail any problems you may have had with noisy neighbours over the years, and how you resolved them. Thanks.

Just tell the landlord. The student will most likely just be as nervous about getting kicked out, and possibly losing a bond, than the landlord is about losing money. If that doesn't work then threaten the landlord with the police.

You mention the student might try and extract some sort of revenge. Tell me, is there anything this student has said or done which gives you this suspicion?

There is nothing he has said or done that suggests he may exact revenge, it's just that people who are unreasonable and infriendly tend to get even more so when you take issue with them over their conduct. Having a gang of friends that are always round aswell is kind of intimidating. The time I had a chat with him he wasnt friendly and just stood there with a stern look on his face and at the end he just walked off.

listen mate i have had this problem loads of times over the years and it is enough to drive you fucking insane.There are only 2 ways to deal with it,the first is the reasonable approach which you have tried and it has got you nowhere so the second is to kick the cunts head in.if you are unable or for whatever reason dont wish to do so yourself then pay someone else to.Believe me you will be glad you did when the flash little student cunt fucks off back to his mum and dad.If you dont know anyone email me and i will put you in touch with the right people.Good luck and now i am off for a nice kip in my peaceful detached house

You need to have a polite chat with the landlord of the flat above. If he shrugs you off and doesn't give a shit, the local council environmental health department is the place to go. They will come out and visit, perhaps put some noise measuring devices in your flat which will measure the level of noise and the time it happens. They will also involve the landlord on an official level by sending him a letter outlining the complaint and the steps they expect him to take.

The worry of intimidation and unreasonable behaviour increasing if you complain is real enough (I had it myself with noisy neighbours) but if you don't complain things won't change at all.

You can get free advice on any housing matter from Shelter. Sometimes it can take ages to get through to them but it is well worth it as they know their stuff inside out.



The Noise Abatement Society are great for advice too, but talk to your landlord initially.

Thanks for the advice. Today I spoke to the owner who said he'd 'have a word' and I also spoke to the people who manage the building who said 'call the Council Noise Team or, failing that, the Police'. So by the time the tenant gets back this evening he will have had a call from his landlord saying that I have been in touch complaining about him. People normally dont take too kindly to this, but so what, he is the one who makes the noise. I remember a place I lived in years ago and I banged on the ceiling late one night when the people upstairs were making a real racket. 'Fuck You!!!' was screamed back at me through the floor. Charming!

I had a similar thing a while ago.

Some twat here (forget the morons name) said it was tough shit and what you deserve.

He was told to fuck off and if any prick replies in a similar manner to you I hope you will do the same.

Arse whipes like the clown causing you nuisance need to be told but if things continue which they may or may not do then don't hesitate to go to the next level.

The fuckwit causing me problems kept trying his luck and is now in the position where he will be prosecuted for any further action.

You do have to have some give and take as far as neighbours are concerned and ignore the kick his head advice which will just give you problems no matter how tempting but as long as you go down the right road then they won't have a leg to stand on.
