advice needed

i spoke to an editor recently about some sets i had to sell and he said send them over and i will look at them.after a month i spoke to him and he said he was busy and hadnt looked at them yet but would do so straight away and send me an email.that was 9 weeks ago.since then i have sent numerous emails,leftr numerous messages on his phone,spoke to colleagues in his office who have left messages for him and set a letter to him by recorded delivery asking him to get in touch with me or send my stuff back and i have heard nothing from him.the office is a couple of hours drive from where i live and i dont want to go up there to be told he isnt there and they cant give me/find my stuff without him.if this has happened to anyone else please can you let me know what to do.am i justified in taking legal action or will he just laugh and say bollocks.all the time it is sitting on his desk it is not making me money

Tell us his name/organisation so the rest of us can avoid him. Can't help you out on legal advice I'm afraid.

You would certainly have the right if they are not the only copy, to repudiate any agreement made due to lack of performance on the other parties part, and take the pictures elsewhere. However in this instance interest attributable to the delay is the only long term loss incurred and isn't worth claiming to be honest.

However if they are the only copy and they have been 'lost' by the other party then I suspect that the small claims court would certainly entertain a reasonable claim for lost profits.

C'mon chaps, lets not be hasty and whip up a lynch mob here. We don't know what reason this editor has if any for the long delay. Lets not judge a man to be guilty before finding out he is eh?

I'll give Davey one thing though, there is no excuse for not returning a phone call at least, what with all the technology and various means of comunication available to us these days. I can definitely see your reason for being pissed off. Naming this editor is probably not the best thing, even if it is who I think it is and they're crap payers anyway. Lets just hope he hasnt published them and expects you to find out by buying the magazine then you can really haul them over the coals, assuming that is, who I think it is.

i dont think it is the right thing to name people on here maybe the bloke had a genuine reason,it was just the bad manners that i didnt like.
