R18 and "Living Off Immoral Earings"

Dear All:

What is the position of R18 and hard-core generally now in the UK with regard "Living Off Immoral Earnings". Pre the "big change" in August 2000, if a model agent took a % of the girl's fee for h-c, that was "LOIE", as the model was regarded, in law, as a prostitute. Similiary if a model lived with a husband/boyfriend that too was "LOIE" on his part.

In May 2002 a case a long this line went to Bow Street Magistrates but the CPS dropped it there, and the defendant was given costs.

Does anyone know that if the CPS/Police regard R18 style hard-core as legitimate and therefore a charge of "LOIE" doesn't apply.

It is perfectly legal to make mainstream porn films in this country. If I was to be taken to court for living off immoral earnings, then the BBFC, the Inland Revenue and the Customs & Excise would all have to be in the dock with me! Between them they make more out of it than I do!

Dear All:

Yes it was the couple in Warrington - June 3rd this year - that this was about - on Melon Farmers for fuler story. The man accepted a Police Caution for "LOIE" as she was modelling both soft and hard core, and they were living together. The Inland Revenue etc are not covered by this law as the charge is:

"Being a MAN did live wholly or in part on the earnings of a prostitute" s.30 SOA(1956)

and a prostitute is, under this section, a female who offers for reward her body for lewdness and not necessarily sexual intercourse.

Wasn't Sabrina Johnson's boyfriend done for this in 1998?

But I think post R18 going hard, in London, at least the CPS wouldn't want to argue it before a jury, but Warrington they might have.

In Dec 1998 I was awarded ?805 costs by the Met Pol Comm because I won a case against them for not returning my vids after a raid --at Dawn!!!
by nine of them, would you believe, Proaby first time such a case. Anyway I beat the cocksuckers at Charing X sand it became a test case - referabble.

Saw the story of the couple from Warrington on Melon Farmers and have always been interested in the law and porn and wondered, how after R18, they would deal with the making aspect in UK, as before they would have used the OPA(1959), to go for supply, and the making was just a "cottage industry", but now it's all out in the open, but the "old laws" are still there, and I've no doubt there are many police who hate the change.

This couple would like some help. She's a model, although I would guess "amateur". Her e-mail is sexychloe4u@btopenworld.com. Had a quick look thru Chloes on BGA and she doesn't seem to be there - probably has been doing Cheshire for years and suddenly gets raided by the local police. He (Husband)accepted the Police Caution on June 3rd, so only a month ago, and so at least one Police Force, has equated making porn with prostitution and hence the so-called "crimes" that flow from prostitution like "LOIE".

I had the opposite happen to me in 1995. I was raided in the 'Your Choice' raids and all they kept was my own private collection of porn that I had been in or shot over the then 12 years that I had been doing it. They managed to twist it around in court that this was my portfolio of work that I used to get myself work therefore gaining financially. So they took it all away and probably distributed it amongst themselves. It was quite a substancial collection that I have never been able to replace and no doubt never will.
This was the second time that the judicial system had stuffed me in this country ( first not porn related ) so I don't trust it at all.
This country sucks and I hate it.

It might be worth checking with the BBFC about what their guidelines are for making porn in the UK.
Obviously, certain Police forces seem to be a 'law unto themselves', and this can either be seen as how they interpret the 'grey' areas of the law or total ignorance of the law.
I can understand the girl not wanting her name in the local paper and to a certain extent the police were probably aware of that, but until someone makes a stand in court I guess this will always be a problem.
