Just picked up this thread, and it strikes a chord with something Sasha and I had exchanged threads on in another section of BGAFD.

As a magazine editor, I'm absolutely delighted if word of my mags is spread around the globe, and the web plays an important part of that. If people want to scan the entire pages and put them on a site, then they only breach the copyright of that magazine (it's the way the images appear in the mag that are copyright of the publisher, whilst the snapper retains total copyright over the images themselves).

However, if that same person then charges other people to come and look at them, then I have a big problem with it, because it's not only copyright infringement, it's theft, pure and simple.

Falcon Fotos in the US earned themselves a $1million settlement after a cowboy did the same thing to them last year. We all know that the web is rife with copyright theft, we can't stop it, but we can still disapprove if people are basically robbing the content creator.

Adobe have an electronic watermarking system for scanned images, and I know a couple of big snappers who have used it on their sites and then sent spiders out to check for those images on other sites. You'd be gobsmacked by the numbers. The next step is to issue a cease and desist order, or sue for lost revenue.

The answer is simple - if you like a certain model, create a free site using scans of her, acknowledging copyright ownership isn't yours, and try to contact the snapper for permission. If you want money, create your own content and charge for it.

I sympathise with people like John and Sascha on this, although I know John takes a far more laid back approach to it. That's probably because I pay him peanuts, so he doesn't think his stuff's worth anything!

This is in fact the answer of the violator after I found him:

To Hans Moser

We gave you a link back on the site to help you get traffic from the pics. You were posting them everywhere, so we
thought that we could use them like the "pics for clicks" program that exist with affiliate programs.

We will wipe all links to Sarah Young on our search engines, links sites, bomis rings and any other sites we have linking into her official page.

Thanks.

And this i s my answer:

You have never asked for any permission. I have never spread my pictures around. I am fighting since three years against copyright violations. Nowhere in the world you can take pictures from a website to create a links site where you profit from without having permission.
Also there was no link also no banner what would be at least explaining, to our official site. Also I have no traffic in my reports from this site. The funny thing is to me, that every time I write to a violator and warn him to use my picture is, that they are getting rude.

best regards,
Hans Moser aka Sascha Alexander
