AFAIK ACS has taken no one to court all they rely on is threatening letters and frightened people with no knowlege of the law or how the internet works. There are a few unscrupulous firms that use these methods it's like spam mail cheap, nasty but effective
I use torrents but the ISP service account is in my landlords name, on top of that about 6 people use the network and for a long time the wifi was secured by W.E.P encryption which a computer savvy 10 year old could hack in 15 mins.
So if my landlord recieved a threatening letter my advice would be to reply "F**k off or prove it".If they persued the matter i would enquire which one of the machines on the network was responsible oh and P.S who was sitting at the machine and operating it. An Ip address by itself is useless.Examine someones PC find the copyrighted material and yes you have a case, this is how most legal experts think a court case would pan out. Of course as you would have ample warning that someone would be trying to issue a court order to examine your P.C and router hey why not do a D.O.D security wipe on your hard drives and for good measure reset your router and use an open wifi connection. Zero proof and anyone within 50m of your router could use your connection so how would you prove it wasn't one of those unknown people piggybacking of your connection
Sorry guys but copyright died a long time ago if the combined forces of national governments, the combined multi-multi billion $ PC games, recording and film producers can't even close TPB then you have no chance. Also if you do crackdown on torrenting then the technology already exists to swap files untraceably

Regretfully Paul, me old friend there is no solution it seems. The demise (particularly here in the UK) of this once great business that attracted people like yourself and indeed me many years before has been staggering in it's severity. A few survive and a few will continue to do so but with profits so minimal now it won't be many. Of course porn will survive and go on in some form or another but the 'new' way we all thought we would make loads of money - the 'tinterweb' is looking like it will actually murder the business !

But here are some observations which i believe to be true and are almost never mentioned by copyright owners
No one has an accurate view of how torrenting effects the porn, music, film etc businesses it's an illegal activity so all claims to % and $ lost are purely guesswork to promote their argument. Claims that the porn/film/music industries will disappear are just bullshit the same claims were made for blank audio/video cassettes and DVD,s. The world changes you have to adapt, a status quo will be reached if you can't adapt you go extinct your fault no one else is to blame.
So how does piracy effect your product well imagine you have seen James Cameron,s latest film on your P.C as a torrent you weren't a fan of his and no way were you going to pay $10 to see it in a cinema but now you want to see it big screen with HQ sound

How much would it cost to pay for all the free PR & advertizing generated by that torrent, i have no idea, no one does
Personally if pirated material was totally unavailable then 90% + of the "freebies" i have i would not purchase period
So if you make a porn film and 5000 legitimate copies are purchased but 10000 pirated copies are D/L for free how does this effect you

It's a very difficult topic and generally speaking the industries involved are totally failing to come to terms with it
Their general reaction is to run around screaming that the "sky is going to fall down", pursue increasingly futile attempts to criminalise and prosecute their customers and use technology like DRM which simply fails 5 minutes after a new method has been implemented
The internet is a golden opportunity for content providers, no more physical content which needs to be produced in a factory, shipped, transported and sits on a shelf uselessly until purchased and it gives you a vastly superior medium for distribution/PR and advertising

Diggler 69 made a very good point that I have shared in some fiercely debated moments on this very topic.
Piracy has always been with us and sure there is some kind of loss that adds up from the many that do it.
But I can also see Pauls point that while he may not share the same view as those who are signed to ACS Law that some people are trying to do something about it by at least trying to do something about it and you cant blame them for trying because while many will debate the moral ethics of it the point is it generates a push to actually trying to do something about it and bring it to the attention of many that may slow it down
I dont think this way will impact much but bear in mind companies like ACS Law are prvoviding this service for free so their clients have the chance to see if it makes a difference or not.
Just talking about it is not proof enough. At least when the smoke clears people can say we've been there and done that and it didnt work.
Sure its unpleasant for soem of those grannies and blokes on the dole who happen to have the internet but I notice its always the sob cases that people latch onto.
